The agreement <br />is within the guidelines established by the Council prior to negotiations. <br /> <br />The Union's acceptance letter notes that standby pay applies to the actual holiday not the <br />"observed holiday" as I suggested to them. Since it is only paid for one or the other , it <br />really doesn't make any difference to the City whether the pay is on the observed day or <br />the actual holiday. Of course the stand-by issue is within the control of the city to assign <br />or not. <br /> <br />Finally, we are implementing a memorandum of understanding (MOU attached) <br />regarding employees with CDL commercial driver licenses. This MOU suggests a <br />process whereby we may choose to keep an employee with a suspended CDL on other <br />duties that do not require a CDL. The process is optional with the employer and until we <br />once use it doesn't bind us to implement the process. <br /> <br />While not in the labor contract, we have agreed to continue discussion of creating a post- <br />employment health plan. Neither party is obligated to agree to this if they don't see a <br />benefit. <br /> <br />I recommend approval of the Labor Agreement and approval of the Memorandum of <br />Agreement regarding CDL drivers (subject to city attorney review). <br /> <br />Dallas Larson, Administrator <br /> <br />j9~ <br />
