<br />City Attorney Hoeft indicated that the City has no control over how the property is <br />divided once it vacates the roadway. He then indicated that the City would follow a <br />simple vacation procedure and the rest is up to the property owners. <br /> <br />Council Member Broussard Vickers indicated that it was her recollection that Council <br />would not hear this matter until it received letters from both sides indicating they were in <br />favor of the vacation. <br /> <br />Mr. Palzer indicated that both property owners wanted to proceed. <br /> <br />Motion by Council Member Broussard Vickers. seconded bv Council Member <br />Nelson to direct staff to begin the process of vacating the Mill Road Extension. <br /> <br />Council Member Travis asked if the property owners were in agreement. Mr. Palzer <br />explained that the state process would determine how the property is divided up not the <br />City. <br /> <br />Mayor Swedberg asked whether the City would incur any costs for the vacation. City <br />Attorney Hoeft indicated that there would not be any costs to vacate the roadway and <br />noted that after the roadway is vacated the division ofthe property is the responsibility of <br />the property owners. <br /> <br />VOTE: Ayes - 4, Nays - 0, Abstain - I(Swedberg). Accept Resignation of Fete des Lacs Committee Members <br /> <br />Motion by Council Member Broussard Vickers. seconded bv Council Member <br />Nelson to approve the Consent Agenda as presented. All in favor. Motion carried <br />unanimously. <br /> <br />XI. COMMITTEE REPORTS <br /> <br />Council Member Capra indicated the Cable Commission would be making a decision in <br />December with regard to AT & T Broadband's proposal to pass franchise fees onto the <br />subscribers. <br /> <br />Mayor Swedberg asked Council Member Capra to determine how much had been spent <br />on the litigation to date and report back to Council because he is concerned that the <br />$17,000 in the cable fund not be exceeded. <br /> <br />Page 8 of 10 <br />
