Brenner and seconded by Mr. Travis to approve the set agenda as noted. <br />I\'.Iotion carried unanimously. <br /> <br />PETITIONS AND COMPLAINTS <br /> <br />None <br /> <br />UNFlNISBED BUSINESS <br /> <br />Special Use Permit (SUP) - Kindergarten Center Rehbein Properties, LLC <br />Mr. Gerald Rehbein (Rehbein Properties, LLC) was present to request SUP approval for a <br />kindergarten center north of Main Street on 20th Avenue. The Council discussed adding <br />contingencies to the proposed SUP. Specifically, the Council requested the SUP include a chain <br />link fence to buffer the playground from the ponding area. <br /> <br />Motion by Mr. Sweeney and seconded by 1\'ls. Nelson to approve the Special Use Permit <br />and to in.corporate a chain link fence to buffer the playground area from the pond. Motion <br />carried unanimously. <br /> <br />\Vater Interconnect <br />Mr. Peterson gave a progress report on the water interconnect between the cities ofLino Lakes <br />and Centerville. :NIr. Peterson explained a Joint Powers Agreement (JPA) dated March 20, 1998 <br />wa.s drafted to connect the 70-ft distance between the current pipes. Furthermore, during a phone <br />conversation, Mr. John Powell (Lino Lakes Engineer) stated the Lino Lakes Council is in <br />agreement with the current draft copy of the contract and it is ready to be signed. Mayor <br />Wilharber mentioned the document was not signed because of the associated cost and ultimate <br />control of the interconnect. Mr. Palzer noted both cities elected to have a telemetry system which <br />was a costly feature. Mr. Peterson referred to a 1998 feasibility report which indicated the <br />telemetry system cost nearly $55,000. <br /> <br />The Council directed Staff and the Engineer to work with Lino Lakes staff to arrive at an <br />agreement and bring the issue before the Council. <br /> <br />Cedar Street Park <br />rvIr March updated the Council on Ceder Street Park. The County requires teL'\: forfeiture <br />property to be sold at the current market value Therefore, if the City elects to transfer the park <br />designation to another use, then the City will be expected to pay the fair market value for the <br />parcel. N1r.
