<br />dev~lopment contract. I have incQrporated a uurnber of your suggestions, but have specit1cally

<br />1. Landscaping. Yout proposed la.i1guagf; is not acceptable. Gwt1.od Deveiopment is and
<br />will be ):espc:tlsible for the landscaping. If Grouud Development wishes to shift its obligmion to
<br />a builder, that i~ between. Ground Devdopme,nt and the builder. Iflandscaping is not performed
<br />per t.lJ,e approved plan and deve.lopment agx$ement, Ground Development v.ill be responsible to
<br />remedy the matter,
<br />
<br />2. The City will not accept a surety bond in lieu of cash or Letter of Credit. TI:1e City does
<br />not wish to fight ,,'\'ith the bOl1d company while violations ofthe agreement are outsta.TJ.ding, The
<br />cash or Letter of Cn;.dit gi'l('~S the City the immediate ability to c;,ddress the defaults. The 150%,
<br />is a City 3tandn:rd and will remain in place,
