Council Member Nelson noted a final draft for a profile was before the Council
for review and comment.

Council/Commission/Committee Discussions and Procedures

Council Member Capra asked that this item be on the agenda to provide staff with
greater direction for staff members with regard to the Park and Recreation
Commission. She indicated it was her understanding, if there were problems,
staff should still be addressed during the interim.

Mayor Swedberg noted Mr. Palzer and Ms. Bender have been given the authority
to supervise people during the interim. The Council concurred not to micro-
manage the day-to-day operations of staff and to continue to have Mr. Palzer and
Ms. Bender supervise staff.

Council Member Broussard Vickers stated this has been the position of the
Council and stated if staff has issues they should be addressed with Mr. Palzer or
Ms. Bender and not be brought to the Council.

Eagle Pass 2nd Addition Association Concerns

Mr. Hoeft noted he reviewed the Developer's Agreement for Eagle Pass along
with the townhome associations concerns. He indicated he analyzed the concerns
of the property owners in conjunction with the agreement.

Mr. Hoeft noted he received a memorandum from Mike Quigley of Gor-em, LLC
addressing eight items that he is willing to address by the end of August. He
explained those eight items to be, completion of the tennis court, replacement of
cracked sidewalk panels, removal and replacement of dead trees, common area
clean up, the cutting of weeds where necessary, completion of all necessary
sodding, clean up of construction sites, and street sweeping as needed. He
indicated this memorandum would be forwarded on to the two townhome
associations.

Mayor Swedberg indicated concern for the structural quality and workmanship
within this development. Mr. Palzer stated the building code would hold these
structures to certain standards.

Council Member Broussard Vickers asked if any action had taken place on these
eight items to date. The president of the Twin Townhomes Association stated he
has seen the d~veloper begin in these areas. He asked that the Council continue to
have open communication with the association presidents to keep them informed
of upcoming Phase II plans.

Council Member Broussard Vickers asked that the Council sit on this item until
the end of August until a progress report could be completed. The Council
concurred.

Page 4 of8
