<br />June 27,2001 <br />Council Meeting Minutes <br /> <br />Pheasant Marsh - Comprehensive Plan Amendments <br /> <br />Mr. March reviewed the comprehensive plan amendments regarding the MUSA <br />additions and utility staging with regard to Pheasant Marsh. <br /> <br />Mayor Swedberg asked if the developer was set on developing this as suggested <br />or if he would consider running the water and sewer down Center Street. Mr. <br />Hannah noted he may need some time to reconsider and asked that the item be <br />tabled. <br /> <br />Motion by Council Member Nelson. seconded by Council Member Capra to <br />table the Comprehensive Plan Amendments as presented by staff. All in <br />favor. Motion carried unanimously. <br /> <br />Waterworks Beach Club Liquor Violation <br /> <br />Mr. March indicated Waterworks received a liquor violation when tested for <br />compliance by the police department. He noted a portion of the Minnesota <br />Statutes that covers license revocation, suspension or civil penalty was included in <br />the packet for the Council to review. <br /> <br />Mr. March also reviewed the City of Plymouth's liquor violation ordinance and <br />subsequent fines. He noted following this code, Waterworks should be fined <br />$500. <br /> <br />Mayor Swedberg asked if this was an allegation or fact. Mr. Hoeft stated this was <br />a fact and noted action was needed by Councilor the State would step in. <br /> <br />Council Member Capra questioned how a five-day suspension would be <br />determined. Mr. Hoeft stated he did not assist in drafting the policy for the City <br />of Plymouth, but noted this was up to the discretion of the Council, as he <br />understands it. He explained the Council would be able to determine these days, <br />if deemed necessary. <br /> <br />Council Member Travis asked that this policy be placed on an agenda for future <br />discussion. He stated he would be in favor of the $500 fine. <br /> <br />Council Member Nelson indicated she felt a $500 fine was not enough of a <br />penalty to show the displeasure of the City with this establishment. <br /> <br />Mayor Swedberg indicated he would like to see Waterworks have their license <br />suspended for a day of business. Council Member Nelson concurred stating the <br />fine would also be acceptable. <br /> <br />Mr. March cautioned the discretion of the Council as the City would not want to <br />show favor to certain establishments over others. Mr. Hoeft concurred. <br /> <br />Mayor Swedberg questioned what action the Council would like to take. He <br />stated he did not know what an appropriate fine would be. <br /> <br />Page 8 of 12 <br />
