<br />MEMO <br /> <br />DATE: June 7, 2001 <br /> <br />TO : Honorable Mayor and Council <br /> <br />FROM: Jim March <br /> <br />RE : Waterworks Violation <br /> <br />............................................................................ <br /> <br />Included in your packet is a memo written by Chief Heckman in regards to a failed <br />compliance check at the Waterworks Beach Club. Also included is a portion ofMN <br />statutes that covers license revocation, suspension or civil penalty and a copy of a letter <br />from the State ofMN that indicates that the State will issue a civil penalty if a city fails to <br />do so. <br /> <br />I have also inquired with surrounding jurisdictions to see if they have adopted a standard <br />policy for violators within their jurisdictions. Also included in your packet is the <br />information that was received from this inquiry. <br /> <br />The City of Circle Pines has an Ordinance that simply restates MN statute 340A.415. <br />The last violation they had was with the Down Under bar and they received a $2000 civil <br />penalty. In speaking to Mr. Keinath, it appears that their Council has decided to issue the <br />maximum civil penalty as a fine for first time offenders. It is unsure whether the Down <br />Under will have a license suspension for this subsequent violation. <br /> <br />The City ofLino Lakes is considering adopting a standard policy. An excerpt from their <br />Ordinance and a memo from their Clerk suggesting a standard to the Lino Lakes Council <br />are included in the packet. In speaking to Linda Waite Smith, she indicates that Lino <br />Lakes is currently looking at adopting a formal standard and they are looking at using a <br />standard that was designed by the City of Plymouth. <br /> <br />The City of Hugo faxed a copy of the proceedings format they used when they decided to <br />suspend the liquor license for the End Zone. The End Zone had been serving alcohol <br />without a license from the city. In speaking to City Administrator Mike Ericson, he <br />indicated that Hugo does not have a standard put in place to address liquor violations. <br />
