Six establishments out of the eleven that were <br />checked failed. <br /> <br />Waterworks Beach Club in the City ofCenterville was one of the six that failed. A formal <br />complaint has been sent to City Attorney Jim Hoeft for review of possible criminal charges <br />against the person (s) involved in procuring alcohol for a minor. <br /> <br />State law allows for civil penalties against any retailer who fails an alcohol compliance <br />check, and the State recommends that the authority issuing the liquor license impose the <br />civil fine. <br /> <br />As Waterworks is licensed by the City of Centerville, I bring this matter to your attention <br />for City Council action. Please note that the State will take civil action against any retailer <br />who fails a compliance check if the licensing authority does not. <br /> <br />Attached please find a copy of the letter sent to the City of Centerville last year from MN <br />Alcohol and Gambling Enforcement Division Director Frank Ball addressing the above. <br />Also attached is a copy of State Statute S 340A.415 with the appropriate area highlighted. <br /> <br />Please contact me should you have any questions regarding the alcohol compliance check <br />program. <br /> <br />Thank you. <br /> <br />
