<br />2 <br /> <br />>- The cable operator may appeal the Commission's decision in state or federal court. <br /> <br />· The only four criteria upon which a denial of renewal may be based are whether: <br /> <br />>- AT &T Broadband has substantially complied with the material terms ofthe exishng <br />franchises and with applicable law; <br /> <br />>- the quality of AT&T Broadband's service, including signal quality, response to <br />consumer complaints, and billing practices (but without regard to the mix or quality <br />of cable services or other services provided over the system) has been reasonable in <br />light of community needs; <br /> <br />>- AT&T Broadband has the financial, legal, and technical ability to provide the <br />services, facilities, and equipment as set forth in its proposal; and <br /> <br />>- AT&T Broadband's proposal is reasonable to meet the future cable-related <br />community needs and interests, taking into account the cost of meeting such needs <br />and interests. <br /> <br />· Normally, the formal ascertainment process goes on simultaneously with the informal process. <br />If an informal agreement is reached, however, there is no need to complete the formal process. <br />Reactivating the formal renewal process would not prevent the Commission from continuing to <br />negotiate with AT&T Broadband informally. <br /> <br />A more detailed description of the formal renewal process follows. <br /> <br />G:\North Meh-o\RenewaJ\Outline of Franchise Renewal.DOC <br /> <br />P.19 <br />
