<br />CENTENNIAL FIRE DISTRICT <br />JOINT POWERS AGREEMENT <br /> <br />(a) In areas outside the District, when fire emergencies may endanger life or property <br />within the district. <br />(b) When use is covered by contracts duly entered into by the District for fire <br />protection or other services outsidtf the District. <br />( c) When necessary to fulfill mutual aid agreements duly entered into by the <br />Committee. <br />(d) In case of major emergency or disaster, when authorized by the Fire Chief, or in <br />his absence, the officer in charge. Such use shall be reported as soon as possible to <br />the Fire Chief of the District. <br />( e) When specifically authorized by the Committee. <br /> <br />Such use, as authorized above for use outside the District, shall be carried out only when <br />the officer in charge has determined that the absence of equipment from the District will <br />not impair the protection of the District. The officer in charge shall have the authority to <br />determine priority in answering calls and to assign equipment and manpower. <br /> <br />SECTION VI <br />UNIFORM FIRE CODES <br /> <br />6.1 All member municipalities agree to adopt the most current Uniform Fire Code, <br />appendixes of the Uniform Fire Code, Appendix E of the Uniform Building Code, and <br />subsequent updates within 120 days of signing this agreement, or within 120 days of <br />adoption by the State of Minnesota of said Uniform Fire Code, appendixes of the Uniform <br />Fire Code, Appendix E of the Uniform Building Code, and updates, which ever occurs <br />later. Member municipalities may exempt agricultural zoning districts from said codes and <br />appendixes until October 1, 1994, when all zoning districts within all municipalities shall <br />comply. <br /> <br />If a municipality elects to choose not to adopt said codes and appendixes in the <br />agricultural zoning districts within its boundaries, that municipality shall indemnify all <br />other municipalities and/or parties to this Agreement and hold them harmless with regard <br />to any possible circumstance or consequence. <br /> <br />Member municipalities that are not in compliance with Section VI of this Joint Powers <br />Agreement, shall be considered in default and subject to Section 2.7 of this Agreement. <br /> <br />SECTION VII <br />FUNDING <br /> <br />7.1 Member contributions. Each calendar year each municipality shall pay to the District its <br />share of the total operating budget as established by the Committee, as provided for in <br />Section VIII of this Agreement. Capital and operating expenses of the District shall be <br />borne by each municipality in this agreement according to the following formulas: <br /> <br />Page # 7 <br />
