<br />Council Member Neal <br />adoption: <br /> <br />introduced the following resolution and moved its <br /> <br />CITY OF LINO LAKES <br /> <br />COUNTY OF ANOKA <br /> <br />. . ~ '! ," <br /> <br />RESOLUTION NO. 96 - 09 <br /> <br />RESOLUTION AMENDING THE .CENTENNIAL FIRE DISTRICT JOINT <br />POWERS AGREEMEN~' II <br /> <br />WHEREAS, The City 9fLino Lakes entered into a Joint Powers Agreement <br />(Agreement) on January 1, 1990 with the Cities of Centerville and Circle <br />Pines to provide fire protection service to their residents, and <br /> <br />WHEREAS, The Steering Committee responsible for overseeing the Agreement has <br />been made aware of several inadequacies in the Agreement, and <br /> <br />WHEREAS, Secti~n V, 2.5 Quorum, of the Agreement requires an amendment because <br />there are occasions when it is difficult to get a quorum to conduct <br />business, and <br /> <br />WHEREAS, Section VII, 7.2, Balancing Formula, 7.3, Adiustment to Formul!:!, and 7.4, <br />Balancing Formula Distribution Rules, of the Agreement does not make <br />sense because figures used in the balancing formula do not represent <br />anything that is related to the fire department and the amounts are <br />unpredictable, <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LINO LAKES, MINNESOTA: <br /> <br />Section V, 2.5 Quorum is hereby amended to read as follows, <br /> <br />Four (4) of six (6) regular Committee Members during special or quarterly <br />meetings shall constitute a quorum provided each municipality is represented <br />by at least one Committee Member, except in situations of default when three (3) <br />of four (4) Committee Members shall constitute a quorum. <br /> <br />Section VII, 7.2 Balancing Formula, 7.3 Adjustment to Formula and 7.4 Balancin2: <br />Formula Distribution Rules are hereby deleted. <br /> <br />Section VII, 7.5 shall be renumbered 7.2. <br />
