<br />Conunittee member John McLean announced a potential conflict of interest in <br />regards to this item since he lives across the street. The Planning Commission <br />motioned to recommend granting a variance for the interior improvements, but <br />indicated that the work would have to be inspected and a building permit issued <br />for the work.. The motion also included to deny a variance for the pole barn <br />addition. One resident mentioned that he thought the pole barn was an eyesore <br />for the neighborhood. <br /> <br />3. Salazar Fence - Mr. and Mrs. Pedro Salazar are requesting a variance to be able <br />to construct a six (6) foot wooden privacy fence in their rear yard. The property is <br />a corner lot located at 7336 Old Mill Road. According to Ordinance they have <br />two front yards. They would like a variance to leave the north side of the fence <br />facing Mill Road located where they have already dug the fence post-holes. <br />These holes are approximately one (1) foot into the road right of way. <br /> <br />The Salazar's have submitted letters from their two adjoining neighbors indicating <br />that they do not have a problem with the proposed fence or its proposed location. <br />The Planning Commission had amended Ordinance #4 to delineate that a corner <br />lot's front yard was the side of the lot that had a street address or the side of the <br />lot that had the narrowest street width. Another conflicting definition in the <br />Ordinance was not removed stating that two front yards have to be maintained for <br />a corner lot. By definition, the most restrictive requirement must be enforced. <br />The Planning Commission plans to amend the Ordinance to remove the two front <br />yard requirements for fences on comer lots. The Planning Commission voted on <br />the variance request. The vote ended up tied three to three with one abstention. <br />One member that voted against the motion is in favor of allowing the fence, but <br />felt that the fence should be allowed to stay in the rigbt of way. The three voting <br />for the motion wanted to grant the variance for the fence, but were not interested <br />in allowing the fence to remain in the street right-of-way. <br />
