<br />permission to enter the land. When the City does any such work, the City may, in <br /> <br />addition to its other remedies, assess the cost in whole or in part. <br /> <br />12. Special Provisions. The City shall not be required to grant grading <br /> <br />permits, building permits or approve and/or release the Plat for recording with the Anoka <br /> <br />County Recorder until all of the conditions of this Agreement have been complied with <br /> <br />including the following conditions: <br /> <br />A. Special AssessmentslHook-Up Fees. During the term of this Agreement, <br /> <br />Developer agrees to pay ~ll real estate taxes, special assessments/hook-up fees to the <br /> <br />Property within the time provided for payment of the same or prior to expiration of the <br /> <br />Security, whichever is earlier. <br /> <br />B. Sewer Access Charge and.Water Access Charge. Sewer Access Charge <br /> <br />and Water Access Charge are to be paid at the time building permits are issued by the <br /> <br />City. Sewer Access Charge, Water Access Charge, permit fees and other charges are <br /> <br />adjusted from time to time and Developer agrees to pay the fees and charges in effect at <br /> <br />the time of making application for building permit. <br /> <br />C. Covenant and Association Documents. Developer shall provide the City <br /> <br />with copies of all document~ associated with maintenance or use of common areas or <br /> <br />shared parking including the Declarations, and all other restrictive covenants and other <br /> <br />documents relating to the Property which shall be reviewed by the City Attorney and <br /> <br />shall be in a form and substance reasonably satisfactory to the City. <br /> <br />D. Right to Proceed. Within the plat or land to be platted, the Developer may <br /> <br />not grade 'or otherwise disturb the earth, remove trees, construct sewer lines, water lines, <br /> <br />31 <br />
