<br />city of CenterviUe <br />Council Meeting Minutes <br />February 14, z007 <br /> <br />Council Member Broussard stated this opened the City up to policing this from a bonding <br />perspective. <br /> <br />City Administrator Larson stated that if property owner received notice from the City, <br />they would be asked a plan of action for the repair and require the sidewalk be repaired <br />within a reasonable time. He indicated if the plan of action was appropriate the City <br />would let them do the repairs. <br /> <br />Council Member Lakso addressed Item 6 on the policy and asked if insPections are done <br />periodically. <br /> <br />City Administrator Larson stated there would be a plan once it is adopted. <br /> <br />Council Member Lee stated it was tabled for a while and it has been read by members. <br />. He indicated the City must have a policy. <br /> <br />Council Member Broussard stated it would not hurt to adopt it and modify it as needed. <br /> <br />City Attorney Glaser stated it is a policy and not an ordinance. <br /> <br />Council Member Paar indicated there are many sidewalks the City would end up paying <br />for, which would increase the taxes. He stated the City could not afford to fix them all <br />without rising taxes. He questioned where to ~w the line for repairs. <br /> <br />Council Member Broussard asked if there is a sidewalk maintenance project to <br />systematically start repairing them. She stated she has a hard time charging residents for <br />sidewalk repairs in front of their homes when everyone uses them. She stated it would be <br />fairer to have all citizens pay for the repairs. <br /> <br />Council Member Paar stated he is in favor of a sidewalk maintenance project to make a <br />good faith effort to repair the sidewalks and trails. <br /> <br />Council Member Lee indicated the City and homeowner are open to lawsuits for not <br />repairing sidewalks if someone is injured. <br /> <br />City Attorney Glaser replied that typically the homeowner would be sued and the City <br />secondarily. The ordinance might need to be changed. <br /> <br />Motion bv Counell Member Broussard. seeonded bv Counell Member Pur. to <br />aDDrove the Sidewalkffrail InsDeetion PoUev as written. All in favor. Motion <br />earried unanimouslv. <br /> <br />. <br />Council Member Broussard asked if staff is available to do the inspection.
