The variance will not adversely affect public health. welfare and safety and will not <br />be detrimental or iniurious to propertY or improvements in the neighborhood. <br /> <br />The variance will not adversely impact public health, welfare or safety. First, the variance <br />allows a single-family home in a single-family residential district. Second, as discussed <br />during the February 6th Planning Commission meeting, in order to address any concerns <br />regarding line of sight the engineers for the Hanzals calculated the line of sight for the 20- <br />foot variance. The engineers calculations illustrated that the 20-foot variance would not <br />impact the line of sight primarily because Lot 6 is on the outside curve of Old Mill Road. <br />Finally, the variance will not be detrimental to the neighborhood. The variance has been <br />reduced from 20 feet to 10 feet in order to bring the house more in line with the <br />surrounding homes. <br /> <br />e. Variances will not be granted that allow a use that is otherwise not a permitted use <br />in the zoninl! district that the subiect prooerty is located. <br /> <br />The 10-foot front setback variance will allow a single-family home in the single-family R- <br />2 District. The desired use is allowed under the Zoning Code. <br /> <br />Conclusions <br /> <br />The Hanzal's 10-foot front-setback variance request meets the requirements for a variance under <br />the City Zoning Code and State Statute. The Hanzals are proposing a reasonable use - a single- <br />family home in a residential district The geography of Clearwater Creek creates a unique lot and <br />the variance addresses the difficulties arising from the property's topography and natural features. <br />In their attempt to address the City's and neighbors' concerns, the Hanzals have reduced their <br />initial variance request to 10 feet. Finally, the Hanzal' s variance request more than meets the <br />undue hardship requirements, it allows a development that builds off the existing residential <br />character of the neighborhood and enhances the surrounding area.
