<br />City Council 2007-02-07, 6:30 p.m. <br />Minutes of Work Session <br /> <br />Present were Mayor Mary Capra, Council Members Michelle Lakso, Jeff Paar, Linda <br />Broussard and Tom Lee. Also present were City Attorney Kurt Glaser, Attorney Bob <br />Deike, Gerry Shannon of Ehlers Associates, Ron Mehl of Beard Group and Administrator <br />Dallas Larson. <br /> <br />John Meyer updated the Council on the financial aspects of the redevelopment and <br />potential tax increment financing need. Ron Mehl reported that Beard Group is still very <br />enthusiastic to move forward with the project and would like to get the development <br />agreement signed as soon as possible. The Council discussed the project phasing and the <br />potential to use eminent domain if the developer is not successful in acquiring all of the <br />properties. Use of eminent domain is limited to where the city will remain the property <br />owner, such as for public parking lots and street right of way. Bob Deike who is assisting <br />the City attorney in the transaction, indicated that he will redraft the development <br />agreement on behalf of the City. The Council expressed concerns that the development <br />of phase one should not move forward until all properties in that phase have been <br />acquired. That language can be incorporated into the agreement with Beard Group. <br /> <br />It was anticipated that the development agreement can be redrafted in about two to three <br />weeks, with a hope of approval by early March. <br /> <br />Adjourned at approximately 8:15 p.m. <br /> <br />Dallas Larson <br />City Administrator <br />
