Spohn <br />Ranch, Inc. reserves the right to inspect any component claimed to be faulty <br />to ensure defects are due to workmanship and/or materials, and not due to <br />other factors. Defects due to accident, negligence, alteration, abuse, misuse <br />and/or incorrect installation are not covered under the above warranties. <br /> <br />o This warranty does not cover damage due to environmental and site <br />conditions including, but not limited to, settling concrete, liquefaction, <br />subsidence, and soil erosion. This warranty does not cover damage due to <br />acts of god including, but not limited to, hurricane, tornado, flood, riot, and <br />fire. <br /> <br />THE WARRANTIES ARE IN LIEU OF ALL OTHER EXPRESS OR IMPLIED <br />WARRANTIES, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY <br />OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND NO <br />PERSON IS AUTHORIZED TO GIVE ANY FURTHER REPRESENTATION OR <br />WARRANTY OR ASSUME ANY FURTHER OBLIGATION ON BEHALF OF SPOHN <br />RANCH, INC. WITH RESPECT TO SPOHN RANCH, INC. PRODUCTS. THE <br />REMEDIES PROVIDED SHALL BE THE EXCLUSIVE AND SOLE REMEDIES OF <br />THE PURCHASER. THE WARRANTIES DO NOT EXTEND TO, AND SPOHN <br />RANCH, INC. SHALL NOT IN ANY CIRCUMSTANCES BE LIABLE FOR ANY <br />DIRECT OR INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE <br />SUFFERED BY ANY PERSON BY REASON OF ANY DEFECT IN WORKMANSHIP <br />OR MANUFACTURE OF THE COMPONENTS OR THE INABILITY TO USE THE <br />COMPONENTS. <br />
