St Paul Water Possibility...

SUbject:

FYI
A possible small bombshell... Maybe?

-----Original Message-----
From: Dan & Mary Capra [mailto:netfalcon@comcast.net]
Sent: Wednesday, October 06, 2004 10:25 AM
To: Jim Hoeft
Cc: LeBlanc, Wayne J; Lee, Tom; Linda Broussard Vickers; Terry Sweeney; Palzer, Paul;
Moore-Sykes, Kim; Jeff Paar
Subject: St. Paul Water Department

Hi Jim,

Just a question I will be asking at our next meeting. I recently read that if a
government body uses condemnation to obtain property for a public purpose, If the property
is no longer need for that public purpose they cannot resell the property for any kind of
profit, it has to stay in use for a public purpose due to it having been condemned.

I spoke with Melvin Dupre this morning and he said in the 1890's the St. Paul Water
Department came into Centerville and did condemnation for the purpose of providing water
utilities to the City of St. Paul. It was at that time they took residential shoreline
and the property in question we (the city) is seeking to purchase. It caused such an up
roar within the community through this condemnation of residents property that the water
department agreed to hire several Centerville residents to work for the water department
as a gesture of good faith.

I can only assume if condemnation occurred the St. Paul Water Department is a government
body and not a private company. And if they obtained the property through condemnation
can they resell the property?

According to one resident the water department had a 99 year lease for the property in
question as well as the shoreline and never actually owned the property to begin with.

I feel this may be worth investigating through Anoka County. Mel said is grandfather was
paid probably only a few dollars through the condemnation process for his shoreline
property.

Mary Capra

1
