<br />... <br /> <br />Subject: Drainage Structure <br /> <br />The City has plans for a bike path along Heritage Street. S1. Genevieve's installed a <br />drainage structure in the right of way that interferes with construction of a bike path. (I <br />have attached two pictures) Perhaps even more, the drainage structure looks to be a <br />danger to public safety and should be out of the right of way for that reason. <br /> <br />I have asked S1. Genevieve's through Tom Wilharber and their contractors and <br />consultants to remove the structure from the right of way to allow at least twelve feet of <br />clear area behind the curb. They filed a plan with the City that had shown the structure in <br />the right of way, but it isn't clear if anyone from the city realized what they were actually <br />planning to construct. Representatives of the St. Genevieve's may suggest that the city <br />should pay for the additional costs to move the structure. I am not sure that we have any <br />obligation to pay anything, even if we were aware of the specifics, but it may come up for <br />discussion. Regardless, I believe that this is a public safety hazard that should not be in <br />the right of way and would be in the way when we build the path. <br /> <br />Dallas <br />
