<br />Effective: 12/26/90 <br />City of Centerville Ord. #50 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br /> <br />CITY OF CENTERVILLE <br /> <br />ORDINANCE #50 <br /> <br />AN ORDINANCE REQUIRING PROPERTY OWNERS TO PROVIDE FOR REMOVAL OF SNOW, <br />ICE, DIRT, AND RUBBISH FROM SIDEWALKS ADJACENT TO THEIR PROPERTY. <br /> <br />The City Council of the City of Centerville does ordain: <br /> <br />SECTION 1. CLEANING OF SIDEWALKS. <br /> <br />All owners of property in the City of Centerville shall provide for the removal of snow, ice, dirt, <br />debris, litter, branches and other obstructions or accumulation of materials from all public <br />sidewalks adjacent to their property within 24 hours after its deposit thereon. <br /> <br />SECTION 2. REMOVAL BY CITY: ASSESSMENT OF COSTS. <br /> <br />Any snow, ice, dirt, debris, branches and litter remaining on the public sidewalks of the City is in <br />violation of this ordinance and may be removed by the Director of Public Works or his designee. <br />The Director of Public Works shall determine the cost of such removal and the owner of the <br />property abutting the sidewalk from which the City has made such removal shall be charged for <br />said cost. <br /> <br />On or before September 1 of each year, the City Clerk shall list the total unpaid charges for <br />removal from a public sidewalk of snow, ice, debris, branches and litter against each separate lot <br />or parcel to which they are attributable under this ordinance. The Council may then spread the <br />assessment charges against the property benefited as a special assessment under Minnesota <br />Statutes, Section 429.101 and other pertinent statutes for certification to the County Auditor and <br />collection along with the current taxes the following year. <br /> <br />SECTION 3. IMPROVEMENTS/OWNERSHIP. <br /> <br />Nothing contained in this ordinance shall prevent the City Council of the City of Centerville <br />from undertaking any public improvement with respect to the construction, maintenance, <br />replacement, repair, relocation, or removal of sidewalks in the City of Centerville pursuant to <br />Minnesota Statutes Chapter 429 or any other applicable ordinance, statute or law. Further, this <br />ordinance shall not be construed as to empower the owner of any land adjacent to any public or <br />municipal sidewalk to claim ownership thereof, to remove any sidewalk without the replacement <br />thereof, or to place or permit any form of barricade, obstruction, or other hindrance to the free <br />passage of any pedestrian thereon, without the express written consent of the City Council of the <br />City of Centerville. <br /> <br />Page 1 of2 <br />
