<br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br /> <br />CITY OF CENTERVILLE <br /> <br />ORDINANCE #54 <br /> <br />AN ORDINANCE REGULATING WEEDS AND GROWING GRASSES AND <br />PROVIDING PENALTIES. <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA DOES <br />ORDAIN: <br /> <br />Section 1. <br /> <br />Section 2. <br /> <br />Section 3. <br /> <br />Section 4. <br /> <br />Definition. "Weeds" shall be defined to mean and include all noxious weeds <br />as defined by the statutes of the State of Minnesota and all such useless and <br />troublesome plants as are commonly known as weeds to the general public. <br /> <br />Noxious Weeds. Because the growth of noxious weeds and other harmful <br />vegetation is subject to needless abuse, creating a detriment to public health, <br />comfort, and safety of the residents of the City of Centerville, as well as, <br />creating a general aesthetic depreciation, the growth of such vegetation is <br />hereby declared to be a public nuisance. <br /> <br />Growing Grass. Weeds or grasses growing to a height greater than twelve <br />(12) inches upon any lot or parcel within the City, or which have gone or about <br />to go to seed, may be declared to be a public nuisance. In determining whether <br />weeds or growing grasses constitutes a public nuisance the foregoing factors <br />shall be considered: <br /> <br />1. <br /> <br />The weeds or grasses are located within 100 feet of an occupied dwelling, office <br />or industrial building. <br /> <br />2. <br /> <br />That the weeds or grasses create a general aesthetic depreciation of the <br />neighborhood. <br /> <br />3. <br /> <br />The weeds are noxious weeds as defined by Minnesota State Statutes. <br /> <br />4. <br /> <br />The weeds or grasses are a detriment to the public health, comfort or safety, of <br />the residents ofthe City. <br /> <br />Enforcement. The Police Department, Zoning Administrator, Building Official <br />or other agents shall enforce the provisions of this Ordinance. These <br />departments shall have the power to inspect private premises and take all <br />reasonable precautions to prevent the commission or maintenance of public <br />nmsances. <br />
