This statute applies to burials on either public or private lands or waters, and <br />includes prehistoric Indian burial mounds as well as historic cemeteries. <br /> <br />Under provisions of this statute, the Office ofthe State Archaeologist (OSA) is charged with identifying, <br />authenticating and protecting these burial areas. The OSA maintains a database of such sites. <br /> <br />Efforts to protect burial sites emphasize "preservation-in-place'~ that is, maintaining the burial area in its <br />original location and condition. <br /> <br />In the event that a burial is either known or suspected to be associated with American Indian peoples, the OSA <br />works in concert with representatives of Minnesota's tribal communities to ensure the integrity of such burial <br />sites. <br /> <br />Anyone planning construction activities who is concerned about the potential for encountering such burials is <br />encouraged to contact the OSA for additional information and assistance.
