If the non-conforming use is discontinued or a non-conforming <br />structure is abandoned for a period of twelve (12) months. <br />Further use of the structure or property must conform to this <br />Ordinance; and <br /> <br />(c.) If a non-conforming use is replaced by another use, the new use <br />shall conform to this Ordinance; and <br /> <br />(d.) If a non-conforming use or structure is damaged by any cause to <br />the extent that repair or replacement costs exceed fifty percent <br />(50%) of the market value, the use or structure may not be <br />replaced or repaired except in conformity with this Ordinance; <br />and <br /> <br />(e.) Normal maintenance of a non-conforming structure is permitted, <br />including necessary non-structural repairs and incidental <br />alterations, which do not extend or intensify the non-conforming <br />use. <br /> <br />Nursing Home or Rest Home. A licensed establishment having <br />accommodations for the continuous care of two or more invalid, <br />infirmed, aged convalescent patients or disabled persons that are non- <br />related. A nursing home as defined in Minnesota Statutes. Section <br />l44A.OL Subd. 5. <br /> <br />Occupancy Permit. Permission received by the City to use/occupy a <br />subject premises. <br /> <br />Open Sales Lot. Land devoted to the display of goods for sale, rent, <br />lease, advertising or trade where such goods are not enclosed within a <br />building. <br /> <br />Open Space. Any unoccupied land space open to the sky. <br /> <br />Ordained. To order by virtue of established authority. <br /> <br />Ordinary High Water Line (OHWL). A line delineating the highest <br />water level which has been maintained for a sufficient period oftime to <br />leave evidence on the landscape. The ordinary high water mark is <br />commonly that point where the natural vegetation changes from <br />predominantly aquatic to terrestrial. <br /> <br />Parcel. A contiguous tract of land, which may consist of unplatted land <br />or one or more platted lots. For purposes of the Zoning Ordinance, <br />adjoining lots which were in common ownership according to the real <br />estate records of Anoka County, Minnesota, will be deemed a single <br />parcel if one or more of the lots are smaller than the minimum lot size <br />required under the Zoning Ordinance. <br /> <br />11 <br />
