<br />and maintained as to comply with the provisions of this Section. The Council may require the <br />owner or operator of a use permitted by this Ordinance to provide such tests or investigations <br />by an independent testing organization satisfactory to the Council as are necessary to show <br />compliance with these standards. The cost, if any, of such investigations and tests shall be <br />shared equally by the owner or operator and the City, unless the results disclose non- <br />compl iance with these standards; in that event the entire cost shall be borne by the owner or <br />operator. This provision does not preclude the City from making any investigations or tests it <br />finds appropriate to determine compliance with these standards. <br /> <br />422.18 On-Site Sewage Treatment Standards. <br />The installation and repair of individual on-site sewer systems shall be in compliance <br />with Minnesota Pollution Control Agency Rules, Chapter 7080. <br /> <br />Subd. I <br /> <br />Permit Required. No person shall install, repair, alter or pump an on-site sewer <br />system without first obtaining a permit. <br /> <br />Subd. 2. <br /> <br />License Required. Installation, repair, pumping and hauling of private on-site <br />sewer systems requires licensing per MPCA Rules, Chapter 7080, as <br />administered by the County. <br /> <br />I 422.17 Nuisance Standards. It shall be deemed a violation of the following standards if a <br />person intentionally acts in a way that violates or fails to act or perform his/her legal <br />duty as required bv these standards. <br /> <br />(a.) Odors and Emissions. Odors and emissions from any use shall not exceed the <br />regulations set forth by Minnesota Pollution Control Agency rules. <br /> <br />(b.) Dust and Particulate. Dust and particulate matter from any use shall be in <br />compliance with and regulated by Minnesota Pollution Control Agency rules. <br /> <br />(c.) Noise and Vibrations. Noise and vibration generation from any use shall be in <br />compliance with and regulated by Minnesota Pollution Control Agency rules <br />and the City's Ordinance # 49. <br /> <br />(d.) Glare. Direct or reflected glare, such as from nood-lights, spotlights, or high <br />temperature processes, and as differentiated from general illumination, shall not <br />be visible beyond the site of origin at any property line. Any lights used for <br />exterior illumination shall be directed away from adjacent properties. <br /> <br />(e.) Waste. All waste generated from any use shall be managed in compliance with <br />and regulated by Minnesota Pollution Control Agency rules. Waste generated <br />on any premises shall be kept in containers designed for waste collection and <br />stored in a structure or within an approved enclosed or screened area. The <br />accumulation, storage, processing or disposal of waste, compost or recyclable <br />materials on any premises, which is not generated on that premises, is <br />prohibited, except as specifically provided in this Ordinance. <br /> <br />Jorrll~!ted:~dent:~~O:'-_ <br /> <br />14 <br />
