<br />423.07 Plan Review Procedure. <br /> <br />. <br /> <br />Subd. 1. Process. Plans meeting the requirements of Section 423.06 shall be <br />submitted by the City Administrator to the Planning and Zoning <br />Commission for review under Section 423.08. The Commission shall <br />recommend approval, approval with conditions or denial. Following <br />Planning and Zoning recommendation, the plan shall be submitted to <br />the City Council at its next available meeting. Action by the City <br />Council must be accomplished within 120 days following the date of <br />the application is filed with the City. <br /> <br />Subd. 2. Duration. Approval of a plan shall expire one (I) year after the date of <br />approval unless construction has commenced in accordance with the <br />plan, unless the applicant makes a written request to the City <br />Administrator for an extension and the reasons for the request. This <br />request will be submitted to the City Council for consideration. An <br />extension of not more than 12 months may be granted. Any plan may <br />be revised in the same manner as originally approved. <br /> <br />Subd. 3. Conditions. A plan may be approved subject to conditions related to <br />the requirements of this Section. Such conditions may, among other <br />matters, limit the size, kind or character of the proposed development, <br />require the construction of structures, drainage facilities, storage basins <br />and other facilities, require replacement of vegetation, establish <br />required monitoring procedures, stage the work over time, require <br />alteration of the site design to insure buffering and require the <br />conveyance to the City or other public entity of certain lands or <br />interests therein. <br /> <br />Subd.4. Security. Prior to approval, the applicant shall execute an agreement in <br />form acceptable to the Council to construct any required <br />improvements, to dedicate property or easements, and to comply with <br />any required conditions. The agreement must be accompanied by case <br />or a letter of credit in form and amount determined by the City Council <br />sufficient to secure performance of the applicant's obligations. <br /> <br />Subd.5. Fees. All applications for plan approval shall be subjected to those fees <br />as outlined in the City's Fee Schedule. <br /> <br />423.08 Approval Standards. <br /> <br />Subd. 1. Requirements. The standards contained in this Section must be met to <br />the degree required by the City Council. <br /> <br />Subd.2. Site Dewatering. Water pumped from the site shall be treated by <br />temporary sedimentation basins, grit chambers, sand filters, upflow <br />
