<br />WHEREAS, upon the request of both owners (1798 & 1806 Main Street) at <br />different times and the consideration of the Planning and Zoning Commission and City <br />Council; and <br />WHEREAS, Minnesota Statute Section 412.851, entitled "Vacation of Streets," <br />authorizes the City Council of a statutory city by resolution to vacate any street on its <br />own motion; and <br /> <br />WHEREAS, the City of Centerville is a duly incorporated Statutory City; and <br /> <br />WHEREAS, a public hearing was held on April 6 and April 14, 2004, which was <br />preceded by two weeks' published and posted notice, to consider of the vacation of the <br />section of located in the City ofCenterville, Anoka County, Minnesota; and <br /> <br />WHEREAS, written notice of said public hearing was mailed to each property <br />owner affected by the proposed vacation at least ten days prior to the hearing (See <br />Attached); and <br /> <br />WHEREAS, the City Council of the City of Centerville declares that it has been <br />determined after due consideration that is in the public interest to vacate that section of <br />Mill RoadlEighth Street (the portion laying easterly of Lot 1, Block 2, westerly of Lot 13, <br />Block 1 Peterson's Addition to Centerville and located south of the southerly right of way <br />line of Hugo Road to the southerly boundary line of the plat of Peterson's Addition to <br />Centerville - 150' X 66') located in the City ofCenterville, Anoka County, Minnesota. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />CenterviIle hereby vacates that section of .Mill Road/Eighth Street (the portion laying <br />easterly of Lot 1, Block 2, westerly of Lot 13, Block 1 Peterson's Addition to Centerville <br />and located south of the southerly right of way line of Hugo Road to the southerly <br />boundary line of the plat of Peterson's Addition to Centerville - 150' X 66') located in <br />the City of Centerville, Anoka County, Minnesota. <br /> <br />ADOPTED BY THE CITY COUNClL OF THE CITY OF CENTERVILLE THIS <br />DAY OF ,2004 <br /> <br />APPROVED: <br /> <br />Terry Sweeney <br />Mayor, City of Centerville <br /> <br />Teresa Bender <br />Clerk, City ofCenterville <br /> <br />The City Hall is ADA accessible.
