Inc. <br /> <br />Mayor Capra asked how much remain~ to be paid. <br /> <br />city Engineer Statz replied about $64,000. <br /> <br />Councilmember Lee questioned what changes were made at the park since the last <br />payment. <br /> <br />City Engineer Statz replied that not much has changed. He pointed out that several items <br />on the request that were not on the previous request. <br /> <br />Councilmember Lee inquired whether the rain garden is repaired. <br /> <br />City Engineer Statz stated that the new rain garden rules equate to a .S-inch rainfall must <br />drain within 48 hours after a rainfall. He indicated that the garden was measured and it <br />aweared to not be draining adequately. He commented that major modifications to the <br />drain tile were made and he believes this would correct the drainage problem. <br /> <br />City Engineer Statz stated that 75% of the payment is requested because they believe the <br />City is well.protected by withholding a percentage of the payment and with a performance <br />bond in place from Veit. He stated that the work is guaranteed for a full year after the <br />project is accepted. <br /> <br />Discussion ensued. <br /> <br />Mr. Dick Travis, 7335 Brian Drive, stated he took offense at the way Council beat up on <br />the contraetor. He questioned Council as to why it would withhold money if the contractor <br />buih the features to design and specifications. He pointed out the other SPeCifications he <br />questioned. He stated that he believed nothing was substanda1d at the park. <br /> <br />Councilmember Lee responded that Council believes the contraCtor performed well except <br />for the rain ganlen. He indicated that Council did not know ifit was due to a design issue <br />or from another reason. He discussed the other items from the list of concerns. He stated <br />that the City intends to pay the contractor once it is satisfied with the work. <br /> <br />Mayor QLpra stated that it is the City's goal to ensure everything is completed correctly. <br /> <br />P.40f6 <br /> <br />4 <br />
