City of Centerville <br />January 26, 2005 <br />Council Meeting Minutes <br />City Attorney Hoeft indicated he picked up the executed administrative search warrant <br />for the property and now he needs to coordinate the scheduling to view the property. <br />2. Pond and Ditch Improvements <br />Mr. Peterson indicated that the request for bids for pond dredging is out. <br />Mayor Capra indicated the Eagle Pass pond is being dredged. <br />Mayor Capra indicated she had a resident telephone her about a semi-truck parked on a <br />residential street and they start it very early in the morning and allow it to run for half an <br />hour. <br />City Attorney Hoeft indicated that the police would need to enforce this under the <br />existing parking or noise regulations. <br />Council Member Lee asked for an update on 6923 Tourville Circle and asked whether the <br />public nuisance has been resolved. <br />Ms. Bender indicated that a letter was in the packet for review under FYI. <br />City Attorney Hoeft asked Council to schedule an executive session prior to adjournment <br />to discuss Ground Development’s special assessment appeal. <br />Council Member Paar informed Council and Staff that he would not be at the next <br />Council meeting. <br />Ms. Bender asked Council to look at the lighting website in anticipation of a decision that <br />will need to be made for lighting for the grant. <br />Council recessed to executive session at 9:08 p.m. <br />X.EXECUTIVE SESSION (CLOSED) – GROUND DEVELOPMENT – PHEASANT <br />ND <br />MARSH (HUNTERS CROSSING 2 ADDITION SPECIAL ASSESSMENT <br />APPEAL <br />Council briefly discussed the pending litigation regarding special assessments assigned to <br />Outlot B, Pheasant Marsh. Legal Counsel recommended that Council abate same due to <br />Ground Development’s desire not to develop the Outlot and retain same as open space. <br />Council reconvened from executive session at 9:18 p.m. <br />XI.
