<br />CITY OF CENTERVILLE <br />SPECIAL SESSION MEETING <br />APRIL 25, 2005 <br />9:00 a.m. <br />Pursuant to due call and notice thereof, the City of Centerville held a special session meeting on <br />April 25, 2005, at City Hall, 1880 Main Street. <br />PRESENT: <br />Mayor Mary Capra <br /> Council MemberLee <br /> Council MemberLakso <br /> Council MemberPaar <br />ABSENT: <br />None. <br />STAFF: <br />City Attorney-Barna, Guzy & Steffen, Ms. Joan Quade <br /> City AdministratorLarson <br />I. CALLTOORDER <br />Mayor Capra called the April 25, 2005, City Council meeting to order at 9:00 a.m. <br />Motion by Council Member Lee, seconded by Council Member Lakso to close the <br />session to discuss pending litigation. All in favor. Motion carried unanimously. <br />Pending Litigation – Lakeland Hills & Royal Industrial Park (Royal Oaks Realty) <br />Ms. Quade reviewed a proposed settlement offer from Royal Oaks Realty. A part of the <br />settlement would be to allow part of the payment to the City to be delayed until <br />November 15, 2005. The second payment would be without any interest accrual. The <br />Council discussed concerns with making sure that the November payment is made as <br />expected and discussed possible methods of securing the payment, including a mortgage <br />on the remaining property of Royal Oaks. <br />Motion by Council Member Paar, seconded by Council Member Lee to reconvene to <br />the special session at 9:20 a.m. All in favor. Motion carried unanimously. <br />Motion by Council Member Lee, seconded by Council Member Paar a approve a <br />proposed settlement agreement provided thatthe City’s attorney verifies that the <br />second payment can be secured by a lien on the land and that the title be checked to <br />make sure that adequate equity is remaining to protect the City’s interests. All in <br />favor. Motion carried unanimously. <br /> <br />
