<br />Councilmember Buckbee confirmed the funds will be taken from the Park and Recreations funds. <br />Mr. March stated $100,000 of park funds are available for the Laurie LaMotte Park. <br /> <br />21st Avenue Road Construction <br />11r. Nyberg addressed an estimate the City received from Gerald Rehbein. :tvtr. Nyberg felt the <br />quotation could be lower, then he suggested the Council wait to see if the estimates decline. In <br />addition, the $24,550 proposal is for a temporary road. The curb and gutter will be installed later. <br /> <br />Councilmember Buckbee commented she would rather invest the $24,000 in the construction of a <br />permanent road. In addition, the business owners along 21st Avenue are required to black top <br />their parking lots when 21 st Avenue is paved. Therefore, Councilmember Buckbee suggested <br />contacting the business owners on 21 st Avenue to inform them of the potential assessment and <br />black top requirements. Mr. Nyberg recommended tabling the issue. <br /> <br />Councilmember Buckbee moved and it was seconded to table the 21st Avenue upl2:rade. Motion <br />carried unanimously. <br /> <br />Tobacco Ordinance <br />1\1s. Gaustad addressed the proposed Tobacco Ordinance #66. Ms. Gaustad stated the ordinance <br />was developed in accordance with the state laws and is similar to the Circle Pines tobacco <br />ordinance. However, the ordinance has been tailored to the City of Centerville Ms. Gaustad <br />noted the ordinance meets with Acting Police Chief Joel Heckman's approval. In addition, all <br />license holders have been notified 30 days prior to Council's consideration. Mr. Hellings stated <br />the ordinance meets with his approval. <br /> <br />Mr. Bill Bisek (7098 Centerville Road) questioned the Council ifremote controlled vending <br />machines are in compliance with the proposed ordinance. The Council discussed the intension of <br />the ordinance and procedures with violators. Ms. Gaustad commented on the state law which <br />states: No vending machines are allowed in establishments where children under the age of 18 <br />have access to the vending machine. <br /> <br />Councilmember Buckbee moved and it was seconded to adopt tobacco ordinance #66 and to <br />authorize Staff to investigate administrative costs for compliance checks and other communities' <br />fees. Motion carried unanimously. <br /> <br />Personnel Policy <br />Mr. March requested council direction on the interpretation of Personnel Policy, Section 11.2 <br />Court Leave "Regular emplovees may be absent with pay when serving jury duty or when <br />subpoenaed as a witness in court or voluntarily serving as a witness in a case in which the City is a <br />party." Mr. March noted the personnel policy does not indicate an allotment oftirne the City will <br />pay for the above-mentioned leave. The Council requested legal councils' interpretation. Mr. <br />Hellings understood the policy allows employees to be absent from work with pay if serving jury <br />duty, subpoenaed or testifying on behalf ofthe City.
