<br />Motion failed for lack of a second. <br /> <br />Councilmember Buckbee suggested striking a $20,000 medium. Mr. Hoeft explained the market <br />value is what the buyer is willing to pay for the property and he warned the Council should <br />establish the property value. Councilmember Buckbee said she was not in favor of a $950 fee nor <br />the 10% charge. Mr. Hoeft cautioned the Council prior to fashioning a motion to consider if <br />enough information is available. Councilmember Buckbee favored having five homes instead of <br />four homes year after year which will be significant revenue compared to the 10% ($50,000) <br />amount. <br /> <br />Mr. Navin arrived at 7:58 p.m. <br /> <br />Mr. Navin explained the Park and Recreation Committee has had limited assistance from the <br />Developer in establishing the purchase price of the property. Mr. Buechler responded the land <br />value is $70,000. Mr. Navin commented that the Park and Recreation Committee has made a <br />good faith effort to meet the Developers and the City's needs. However, no recommendation <br />could be given because of insufficient information. Mr. Buechler stated that he called City Hall <br />and was told the park dedication funds were $950 per lot. Mr. Hoeft replied that it is due <br />diligence to read the ordinance instead of asking someone what the ordinance states. <br /> <br />Councilmember Buckbee moved to table Buechler Estates due to the Developer not <br />submitting enough information on the plat. CouncilmemberBrenner seconded the motion. <br />Motion carried unanimously. <br /> <br />Center Villa Preliminary Plat <br />Mr. March briefed the Council on the 22 lots on the 13 acre Center Villa preliminary plat. A few <br />minor changes have been implemented based on a meeting with the developer, engineer and staff. <br />The developer is proposing to finance the project independently and is scheduled for Rice Creek <br />Watershed approval this evening. <br /> <br />Mr. March explained the Planning and Zoning Commission recommended approval of the <br />preliminary plat at their meeting on October 6. The Commission recommended variances be <br />granted on Lots 3, 4, 5, 9, 10 and any other lots that the lot width at building setbacks did not <br />meet the required 100 feet per the R2 zoning requirements. The rationale for this was due to the <br />generous lot sizes and the protection of the existing wetlands. The variance requests are for less <br />than ten feet per lot at the building setback. Furthermore, the Commission recommended an <br />additional variance be granted for the extra width requirement for Lot 20 because it is a butt lot <br />and is 3' too narrow. Mr. Willie Lessard (6995 20th Avenue) noted the Planning Commission did <br />not desire Brian Drive to be a through street to 20th Avenue and thus the cul-de-sac will keep the <br />traffic contained. <br /> <br />Councilmember Brenner commented the comprehensive plan clearly states a collector road <br />connects to 20th Avenue. <br /> <br />4 <br />
