<br />Council Meeting November 13, 1996 <br /> <br />~ <br /> <br />to know where his money is going. Mr. Goertz stressed his interest in identifying <br />allocation of costs associated with Clearwater Meadows. <br /> <br />Hellings interjected; the issues could perhaps be ironed out in a meeting between staff and <br />Mr. Goertz, then bring the results back to the council. Hellings explained the council's <br />options are to either adopt the assessments noting the objection was timely received. <br />Which gives the developer 30 days to appeal to the district court or, ifthe council so <br />chooses, to direct staff to sit down with the developer and the developer's attorney to see <br />if the questions can be appropriately answered. If not, perhaps allow the litigation to <br />continue, as Mr. Hellings was comfortable with either option. <br /> <br />March asked Carolyn Drude if the assessment role had to be adopted for the cash flow <br />situation for the City, since the City has been cash flowing this project based on the sale of <br />the bonds and the timing of the cut off for certification. Drude responded her recollection <br />ofthe meeting was 5 years and callable in 3 years. Further, the bonds are good through <br />tonight only. <br /> <br />Hellings suggested if the Engineer is comfortable to sit down with Mr. Goertz and his <br />Attorney, they do so. An executive meeting with the council and attorney was held to <br />discuss an employee issue. <br /> <br />- <br /> <br />Nyberg asked if anyone had further questions, prior to the break. Fogerty agreed with Mr. <br />Goertz and thought the construction costs were too high. Fogerty explained his <br />assessment was based on benefit whereas, the Developer's assessments are based on cost <br />of construction. Mark Edberg of 7072 Brian Drive asked if his well goes bad could he <br />replace it. Nyberg said no, once it goes bad he would have to hook up. <br /> <br />MOTION by Helmbrecht, seconded by Brenner, to close the meeting as the council <br />discuss an upcoming personnel issue. Helmbrecht suggested in the meantime the <br />Engineer and Mr. Goertz discuss the Clearwater Meadows and Brian Drive assessments. <br />Motion carried unanimously. <br /> <br />Meeting was closed at 7:30 PM. <br /> <br />7:30 PM Tom Wilharber arrived. <br /> <br />Helmbrecht reconvened the November 13, 1996, Council Meeting at 8:00 PM. <br /> <br />APPROVAL OF THE MINUTES <br />MOTION by Helmbrecht, seconded by Brenner to approve the October 23, 1996, council <br />meeting minutes with corrections.
