<br />January 14,2008 <br /> <br />Dear City Administrator, <br /> <br />Weare formally requesting an extension for the front setback variance that was granted on <br />March 6th. 2007. The variance was approved subject to: <br /> <br />4. This variance shall expire if the approved plan is not implemented and the home <br />constructed within twelve months of the date of the approval by the City Council. <br /> <br />This request is being made due to improvements not being completed until December 2007, <br />prohibiting the start of the structure as outlined in the developer's agreement (section 24 D). [ <br />... building permits may be issued for two (2) single-family model home on lots Six and Four <br />in Clearwater Creek Estates, upon the city's receipt of the certified "as constructed" grading <br />plan ... J <br /> <br />While the one year limit to act on a variance may be appropriate in most situations where <br />action can be taken immediately, it does not appear to apply in development scenarios where <br />a variance cannot be acted upon due to restrictions in a developer's agreement. <br /> <br />We would like to request a 6 month extension past the existing deadline of March 6th., <br />2008. <br /> <br /> <br />an <br />7381 Old Mill & <br />CenterVille, MN 55038 <br />
