<br />-19- <br /> <br />51.02. PUBLIC HEARING. Before acting on any subdivision <br />plan, the Planning and Zoning Commission shall <br />arrange for a public hearing thereon, after giving <br />notice of the time and place in the official <br />newspaper of the City at least ten (10) days prior <br />to the day of the hearing. <br /> <br />51.0]. VARIANCES. The Council may grant a variance upon <br />receiving a report from the Planning Commission <br />in any particular case where the subdivider can <br />show that by reason of exceptional topography <br />or other physical conditions, the strict compliance <br />with these regulations, could cause unnecessary <br />hardship. Application for such a variance shall <br />be made in writing by the subdivider at the time <br />the preliminary plat is filed with the Clerk. A <br />variance thus granted shall be recorded in reso- <br />lution form entered in the minutes of the Council <br />setting forth the reasons which justified the <br />action. <br /> <br />51.04. INSPECTION. When the plans of streets and other <br />improvements have been approved as provided in this <br />ordinance, the subdivider shall first notify the <br />Clerk of his intention to proceed with the con- <br />struction or installation of said streets and <br />improvements-, notification shall be made at least <br />twenty-four (24) hours before any such construction <br />or installation shall commence so as to give the <br />City officials an opportunity to inspect the site <br />prior to commencement of work and to inspect <br />installation or construction of said streets and <br />improvements during the course of work being per- <br />formed. In order to defray a part of the costs <br />incurred by the City in inspecting the installation <br />of the improvements required by the ordinance, the <br />subdivider shall, before he proceeds with any <br />construction or installation present a certified <br />check or money order made payable to the city in <br />an amount equal to three percent (3%) of the City <br />Engineer's estimate of the cost of the improvements. <br /> <br />51.05. MAINTENANCE BOND. After the utilities and streets <br />are approved, the developer shall furnish the City <br />with a one (1) year maintenance bond equal to <br />twenty (20%) percent of the construction costs. <br />During the one (1) year maintenance bond period, <br />the City will perform routine maintenance. Any <br />unusual problems shall be corrected by the developer. <br />After one (1) year, the City Engineer will inspect <br />the utilities and streets. If everything is <br />acceptable, the City will accept full responsibility <br />from that point on. <br />
