Pursuant to due call and notice thereof, the City Council of the <br />City of Centerville held their regular meeting on October 11, <br />1989 at City Hall. Mayor Haberman called the meeting to order at <br />7 : 00 p.m. Present: Peterson, Pe lton , Burgstah ler , Neumann. <br />Motion by Peterson, second by Pe lion to accept the minutes of the <br />September 27, 1989 City Council meeting, motion carried <br />unanimously. <br />OLD BUSINESS: <br />No one was present to represent the National Ataxia Association. <br />Discussion of the 1989 Street Patching and School Zone Sidewalk. <br />Brian Miller, City Engineer, presented a letter from Maier, <br />Stewart and Associates dated September 27, 1989 recommending that <br />the City Council approve payment of estimates #3 and #4 in the <br />amounts of $6,401.00 and $3,431.34 respectively. <br />Motion by Burgstahler, second by Neumann to approve partial pay <br />estimates #3 in the amount of $6,401.00 and #4 (final) in the <br />amount of #3,431.34 for the 1989 Street Patching and School Zone <br />Sidewalk project as reflected in the Maier, Stewart & Associates <br />letter dated September 27, 1989 to Bituminous Consulting and <br />Contracting; contingent upon the contractor signing these <br />estimate forms, motion carried unanimously. A copy of the <br />September 27. 1989 letter from Maier, Stewart & Associates is on <br />file with the Clerk/Administrator. <br />Motion by Peterson, second by Pelton to direct the City Staff to <br />write a letter to the Centennial School Board informing them of <br />the completion of the sidewalk along Main Street from Mill Road <br />to Progress Road; clarify to them that along Progress Road there <br />will be additional signage and new striping; include a copy of <br />the diagram for that area; explain that lack of easements <br />preclude the possibility of constructing a sidewalk along the <br />boulevard on Progress Road, motion carried unanimously. <br />Discussion of the Centennial Fire District Joint Powers <br />Agreement. <br />Motion by Haberman, second by Peterson to approve the October 91 <br />1989 draft of the Centennial Fire District Joint Powers Agreement <br />noting the following changes for evaluation and correction: <br />- Page 3, section 2.5, "Quorum <br />now reads: ...when four (4) of five (5) Committee... <br />should read: ...when three (3) of four (4 ) <br />Committee.., <br />- Page 3, section 2.7, "Default, voting Authority" <br />now reads: ...defaulty terms or... <br />should read: ... default of any terms or ... , <br />Page 4, section 3.1, "Arbitration Procedures", <br />
