<br />ORDINANCE #49 <br /> <br />AN ORDINANCE REQUIRING THE MAINTENANCE, REPAIR, SNOW AND ICE <br />REMOVAL, DIRT AND RUBBISH REMOVAL, AND DESIGNATION OF LIABILITY <br />WITH RESPECT TO SIDEWALKS WITHIN THE CITY OF CENTERVILLE. <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE, MINNESOTA DOES <br />ORDAIN: <br /> <br />SECTION 1. That the owner of any property abutting any municipal <br />or public sidewalk in the City of Centerville shall have the <br />obligation of all maintenance, repair, ice and snow removal; <br />removal of debris, branches, litter; and elimination of any <br />other obstruction, accumulation of material, or dangerous <br />condition whatsoever. <br /> <br />SECTION 2. That any property damage or personal injury which is <br />caused by any condition upon any municipal or public <br />sidewalk within the City of Centerville which is declared to <br />be a negligent, hazardous or dangerous, entitling any <br />person, firm, corporation, or entity to damages, shall be <br />the sole responsibility and liability of the adjacent owner <br />of the property charged in Section 1 of this ordinance for <br />the duties therein imposed; which owner shall further have <br />the obligation of indemnifying the City of Centerville for <br />any such damages which the City of Centerville is required <br />to pay. <br /> <br />SECTION 3. That with respect to the accumulation of snow, ice, <br />debris, branches, and litter the owner charged with the <br />responsibility for the removal of the same from any public <br />sidewalk in the City of Centerville pursuant to Section 1 of <br />this ordinance, shall remove all snow, ice, debris, branches <br />and litter from said sidewalk no later than twenty-four (24) <br />hours after its deposit thereon fall thereon. All <br />obstructions not removed as herein provided shall constitute <br />a public nuisance, and may be removed by the municipality at <br />the expense of the owner of the property. The municipal <br />officer or employee in charge of such removal shall keep a <br />record of the costs and expenses incurred for such removal <br />and shall report the same forthwith to the City Clerk who <br />shall maintain a record thereof. <br /> <br />SECTION 4. On or before September 1 or each year, the City Clerk <br />shall list the total unpaid charges for removal from a <br />public sidewalk of snow, ice, dirt, and rubbish against each <br />separate lot or parcel to which they are attributable under <br />this ordinance. The Council may then spread the assessment <br />charges against the property benefited as a special <br />assessment under Minnesota Statutes, Section 429.101 and <br />other pertinent statutes for certification to the County <br />Auditor and collection along with the current taxes the <br />following year. <br />
