council member Wilharber introduced the following Resolution and moved its adoption. RESOLUTION RESOLUTION APPROVING THE VACATION OF A PORTION OF MILL ROAD LAYING 800 FEET NORTH OF THE INTERSECTION OF MILL ROAD AND PELTIER LAKE DRIVE WHEREAS, the Centerville City Council, on its own Motion, proposed to vacate approximately 800 feet of Mill Road laying north of its intersection with Peltier Lake Drive; described as follows: That part of the Southeast Quarter of Section 14, Township 31, Range 22, Anoka County, Minnesota, which lies Northerly of the Easterly extension of the South line of Outlot 0, Acorn Creek, according to said plat on file and of record in the office of the County Recorder, Anoka County, Minnesota, and Southwesterly and Southerly of a line parallel to the distant 66.00 feet Southwesterly of the Northeasterly right- of-way line of Old Mill Road as dedicated in said plat of Acorn Creek Except easement rights for public utility and drainage purposes. WHEREAS, a public hearing with respect to said vacation was set for April 7, 1993 in accordance with Minnesota Statues; and, WHEREAS, a Notice of Publication published and posted two weeks prior to the 1993; and, of said hearing was meeting of April 7, WHEREAS, the City Council did hold a public hearing on April 7, 1993 to inform any and all interested persons relevant to the vacation of said permanent roadway easement; and, WHEREAS, it was determined by the City Council that said permanent roadway as described above is not needed for roadway purposes; and, WHEREAS, the Centervi11e City Council reserves easement rights for utility and drainage purposes over, under and across said vacated roadway. NOW, THEREFORE, BE IT RESOLVED by the City of Minnesota, that the perpetual easement of Mill approximately 800 feet north of its intersection Lake Drive described below is hereby vacated.
