<br />council member Wilharber introduced the following Resolution and <br />moved its adoption. <br /> <br />RESOLUTION <br /> <br />RESOLUTION APPROVING THE VACATION OF A PORTION OF MILL <br />ROAD LAYING 800 FEET NORTH OF THE INTERSECTION OF MILL ROAD <br />AND PELTIER LAKE DRIVE <br /> <br />WHEREAS, the Centerville City Council, on its own Motion, <br />proposed to vacate approximately 800 feet of Mill Road laying <br />north of its intersection with Peltier Lake Drive; described as <br />follows: <br />That part of the Southeast Quarter of Section 14, Township <br />31, Range 22, Anoka County, Minnesota, which lies Northerly <br />of the Easterly extension of the South line of Outlot 0, <br />Acorn Creek, according to said plat on file and of record in <br />the office of the County Recorder, Anoka County, Minnesota, <br />and Southwesterly and Southerly of a line parallel to the <br />distant 66.00 feet Southwesterly of the Northeasterly right- <br />of-way line of Old Mill Road as dedicated in said plat of <br />Acorn Creek <br /> <br />Except easement rights for public utility and drainage <br />purposes. <br /> <br />WHEREAS, a public hearing with respect to said vacation was <br />set for April 7, 1993 in accordance with Minnesota Statues; and, <br /> <br />WHEREAS, a Notice of Publication <br />published and posted two weeks prior to the <br />1993; and, <br /> <br />of said hearing was <br />meeting of April 7, <br /> <br />WHEREAS, the City Council did hold a public hearing on April <br />7, 1993 to inform any and all interested persons relevant to the <br />vacation of said permanent roadway easement; and, <br /> <br />WHEREAS, it was determined by the City Council that said <br />permanent roadway as described above is not needed for roadway <br />purposes; and, <br /> <br />WHEREAS, the Centervi11e City Council reserves easement <br />rights for utility and drainage purposes over, under and across <br />said vacated roadway. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City of <br />Minnesota, that the perpetual easement of Mill <br />approximately 800 feet north of its intersection <br />Lake Drive described below is hereby vacated. <br /> <br />Centervi1le, <br />Road laying <br />with Peltier <br /> <br />RESOLUTION <br />
