<br />Council member Brenner introduced the following Resolution and <br />moved its adoption. <br /> <br />RESOLUTION <br /> <br />RESOLUTION RESCINDING PETITIONS FOR IMPROVEMENTS PURSUANT <br />TO MINNESOTA STATUTE 1030.705 FOR THE CLEAR WATER CREEK <br />FLOOD PLAIN REDUCTION PROJECT. <br /> <br />WHEREAS, on or about December 11, 1991, the Centerville City <br />Council passed a Resolution supporting petitions for improvements <br />pursuant to Minnesota Statues 1030.705 and authorized the <br />presentation of the petitions to the Rice Creek Watershed <br />District for the Clear Water Creek Flood plain Reduction Project. <br />These petitions were in captions "In the Matter of Judicial Ditch <br />No. 3 for Washington and Anoka Counties" and "In the Matter of <br />Anoka County Ditch No. 47"; and <br /> <br />WHEREAS, the Centerville City council and the Rice Creek <br />Watershed District have agreed that the City of Centerville may <br />proceed with the improvements pursuant to a joint powers <br />agreement which is to be entered into between the parties. <br /> <br />NOW, THEREFORE, BE IT <br />City of Centerville, <br />improvements pursuant to <br />rescinded. <br /> <br />RESOLVED by the City Council of the <br />Minnesota, that the petitions for <br />Minnesota Statute 103.705 are hereby <br /> <br />The motion for the adoption of the foregoing resolution was duly <br />seconded by Mayor Buckbee, and upon vote being taken thereon, the <br />following voted against the same: none, and the following were <br />absent: none, whereupon said Resolution was passed this 8th day <br />of December, 1993. <br />r /), <br />; ~/ i 1_ <br />,. ~ . .~:......
