<br />(4) It is unlawful for any person to "jumper" or by any means or device fully or partially <br />circumvent a municipal utility meter, or to knowingly use or consume unmetered utilities or use the <br />services of any utility system, the use of which the proper billing authorities have no knowledge. <br /> <br />(5) No person shall make any connection of an electrical welder to the city water main, <br />appurtenance or service or use an electric welder for the purpose of thawing frozen water mains, <br />appurtenances or services. <br /> <br />(J) Municipal utility services and charges a lien. <br /> <br />(I) Payment for all municipal utility service and charges shall be the primary responsibility <br />of the fee owner of the premises served and shall be billed to the owner unless otherwise contracted for <br />and authorized in writing by the fee owner and any other person (such as a tenant, contract purchaser, <br />manager and the like), as agent for the fee owner, and consented to by the City ofCenterville, <br />Minnesota. If the utility service and charges are for a single metered multi-unit rental residential <br />building, the owner of the building shall be the customer of record and this responsibility shall not be <br />waived by contract or otherwise. The city may collect the same in a civil action or, in the alternative <br />and at the option of the city, as otherwise provided in this chapter. <br /> <br />(2) Each such account is hereby made a lien upon the premises served. Delinquent accounts <br />may be submitted at any time for collection of the delinquent amounts against the respective properties <br />served as set forth in division (J)(I) above. <br /> <br />(K) Damage to municipal utility equipment. It is unlawful for any person to intentionally cause <br />any damage to any municipal utility equipment or appurtenance, including, but not limited to, meters, <br />street lights, water hydrants and curb cocks. Anyone intentionally causing the damage shall pay the <br />reasonable value thereof to the city, including labor for renewal and installation of any equipment and <br />shall be, in effect, an insurer of any equipment in his or her possession or with which he or she comes <br />in contact. <br /> <br />(L) Municipal utility service outside the city. Service to any other municipality may be considered <br />by the City Council. Where it is determined that it is feasible and in the interest of the city, service will <br />be provided only after a legal contract has been agreed to and executed by the adjoining municipality. <br /> <br />(M) Water meters. <br /> <br />(1) Charges. A charge shall be made to property owners or account holders of residential, <br />commercial, industrial or institutional structures for all new meters. Payment for meters shall be made <br />in advance before delivery for installation. The charge will be the actual cost to the city of supplying <br />the meter plus any applicable taxes and reasonable administrative expenses. <br /> <br />(2) Maintenance and repair. The city shall maintain and repair all meters of three-fourths <br />inch size and smaller, when rendered unserviceable through ordinary wear and tear. However, when <br />replacement, repair or adjustment of any meter is rendered necessary by the act, neglect or carelessness <br />of the owner or occupant of any premises, any expense caused the city thereby shall be charged against <br />and collected from the owner or occupant of the premises.
