<br />, <br /> <br />.., <br /> <br />.I <br /> <br />CITY OF CENTERVILLE <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION 97-26 <br /> <br />A RESOLUTION REQUESTING AUTHORIZATION FROM THE ANOKA COUNTY <br />BOARD OF COMMISSIONERS FOR SNOWMOBILE USE ON THE NORTH AND <br />SOUTH SHOULDER OF COUNTY STATE AID HIGHWAY 14 (MAIN STREET) <br />FROM MILL ROAD TO COUNTY STATE AID HIGHWAY 21 (20TH A VENUE) IN <br />THE CITY OF CENTERVILLE. <br /> <br />WHEREAS, on November 12, 1997 the City Council of the City ofCenterville moved to request <br />authorization from the Anoka County Board of Commissioners to allow snowmobile use on the <br />north and south shoulder of County State Aid Highway 14 (Main Street) from Mill Road to <br />County State Aid Highway 21 (20th Avenue), because the safe operation of snowmobiles in the <br />remaining portion of right-of-way adjacent to County State Aid Highway 14 is not possible; and, <br /> <br />WHEREAS, the safe operation of both vehicles and snowmobiles on this section of County State <br />Aid Highway 14 in this area is possible: <br /> <br />WHEREAS, Minn. Stat. 84.87, subd, 1A provides in part, "No person shall operate a <br />snowmobile upon the roadway, shoulder, or inside bank or slope of any Trunk, County State Aid, <br />or County Highway in this state and, in the case of a divided Trunk or County Highway, on the <br />right-of-way between the opposing lanes of traffic . . . ," and, <br /> <br />WHEREAS, Notwithstanding the provisions of Minn. Stat. 84.87, subd. 1A, a county may, <br />pursuant to Minn. Stat. 84.87, subd. 3, by resolution, allow for snowmobile traffic on the shoulder <br />of a County State Aid Highway if the county finds that safe operations in the ditch or outside <br />bank or slope thereof is not possible; and, <br /> <br />WHEREAS, Minn. Stat. 84.87, subd. 1A, provides, "Nothing in this section or chapter 169 shall <br />prohibit the use of snowmobiles within the right-of-way of any state trunk or county state-aid <br />highway or upon public lands or waters under the jurisdiction of the commissioner of natural <br />resources, in any organized contest, subject to the consent of the official or board having <br />jurisdiction over the highway or public lands or water. In permitting such contests, the official or <br />board having jurisdiction may prescribe such restrictions or conditions as they may deem <br />advisable," and, <br /> <br />WHEREAS, Minn. Stat. 84.804, subd. 1, b, states, "A person may not operate a vehicle off-road <br />within a public road right-of-way between the hours of one-half hour after sunset to one-half hour <br />before sunrise, except on the right-hand side of the right-of-way and in the same direction as <br />traffic on the nearest lane of the road." and, <br />
