A copy of that resolution is enclosed. <br /> <br />The County's earlier action to suspend intrastate designation expired on June 9, 1997, when the United <br />States Court of Appeals for the Eight Circuit reinstated intrastate designation in Ben Oehrleins and Sons and <br />Daughter.. Inc. v. Hennepin County 115 F. 3rd 1372 (8th Cir. 1997). <br /> <br />By this correspondence and the enclosed resolution, we are notifying you that effective October 1, 1997, <br />all mixed municipal solid waste generated in Anoka County is to be delivered to the Elk River Resource <br />Recovery Facility as required by the Anoka County Solid Wasted Ordinance unless it is disposed of outside <br />the State of Minnesota. <br /> <br />The county's designation requirement is necessary to further the public's interest, including: landfill <br />abatement; production of energy; conservation and recovery of resources; and compliance with goals of the <br />Waste Management Act. <br /> <br />If you have any questions concerning this matter, please call Mike Stratton at 422-6986. <br /> <br />S incerel y , <br /> <br />/)~1 /;l <br />.I " ~~,/ / ---- , <br />;f; ::1;, ,/./ C'-~--- <br /> <br />Robert.
