<br />RESOLUTION 97-08 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br />CITY OF CENTERVILLE <br /> <br />A RESOLUTION DISSOLVING NORTH METRO RECREATION COMMISSION. <br /> <br />WHEREAS, the Cities of Centerville, Circle Pines, Lexington and Independent School District <br />#12, all located in the County of Anoka, State of Minnesota, entered into a Joint Powers <br />Agreement on April 11, 1991, establishing the North Metro Recreation Commission pursuant to <br />Minnesota Statute Section 471.59; and <br /> <br />WHEREAS, the North Metro Recreation Commission was developed for the purpose of <br />providing a recreation program for the involved communities; and <br /> <br />WHEREAS, the delivery of recreation programs and participant involvement have not reached <br />the original goals of the program; and <br /> <br />WHEREAS, the cities are desirous of looking for a more cost-effective delivery of recreational <br />services; and <br /> <br />WHEREAS, Article V, Section 1, of the Joint Powers Agreement, provides that the North Metro <br />Recreation Commission may be terminated any time by a majority vote of the City Councils and <br />the School District; and <br /> <br />WHEREAS, Article V, Section 3 of the Joint Powers Agreement provides for the division of <br />assets; <br /> <br />NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Centerville, <br />Anoka County, Minnesota as follows: <br /> <br />1. The City Council resolves to terminate the North Metro Recreation Commission <br />Joint Powers Agreement effective May 31, 1997. <br /> <br />2. The Cities and the School District mutually agree to return any contributions paid <br />by any of the four members during calendar year 1997. <br /> <br />3. The Cities further agree that any balance of funds or assets shall be distributed <br />pursuant to the provisions of Article V, Section 3 B, of the North Metro <br />Recreation Joint Powers Agreement. <br />
