<br />external networks or computers can cause such excessive computer usage or <br />even damage a system and so would be a violation of this policy. <br /> <br />24-8 Questions Regarding Policy <br /> <br />City employees who have concerns or are uncertain about ethical, legal or <br />security issues regarding the use of data communications tools are expected to <br />discuss their concerns with their supervisor who will act as the employee's first <br />point of contact. <br /> <br />Part of the responsibility of the City Administrator is to insure the integrity of City <br />data (an asset). Therefore, the City Administrator, in consultation with the City <br />Attorney, will resolve and answer any questions about this Acceptable Use Policy <br />or its interpretation. Until such issues are resolved, questionable use should be <br />considered "not acceptable". Questions of interpretation should be submitted, in <br />writing, to the City Administrator. Final authority for this Acceptable Use Policy <br />lies with the City Council. <br /> <br />24.9 Policy Violations <br /> <br />The City Administrator will review all alleged violations of this City policy on a <br />case-by-case basis. The City Attorney may be consulted for technical assistance <br />in investigating a complaint. Violations of the policy which are not promptly <br />remedied may at the discretion of the City and consistent with the Personnel <br />Policies or appropriate bargaining unit agreement, result in the expulsion of the <br />offending employee from the City's network services in addition to disciplinary <br />action. <br /> <br />25 NON-DISCRIMINATION POLICY <br /> <br />That the City and all employees thereof are subject to a policy of non-discrimination <br />on the basis of race, color, age, creed, religion, national origin, sex, marital status, <br />sexual orientation, status with regard to public assistance, disability or membership <br />or activity in a local commission. <br /> <br />26 SAVINGS CLAUSE <br /> <br />This policy is subject to the laws of the United States and the State of Minnesota; in <br />the event that any provision shall be held to be contrary to law by a court of <br />competent jurisdiction from whose final judgment or decree no appeal has been <br />taken within the time provided, such provision shall be void. All other provisions of <br />the policy shall continue and remain in full force and effect. <br /> <br />38 <br />
