<br />ORDINANCE #29 <br />CI TY OF CENTERVILLE <br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br /> <br />AN INTERIM ORDINANCE REGULATING THE USE AND DEVELOPMENT OF AND <br />WITHIN THE CITY OF CENTERVILLE FOR THE PURPOSE OF PROTECTING <br />THE PLANNING PROCESS AND THE HEALTH, SAFETY AND WELFARE OF THE <br />CITY . <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE DOES HEREBY ORDAIN: <br /> <br />SECTION 1. LEGISLATIVE FINDINGS OF FACT <br /> <br />The City of Centerville is a predominently residential and <br />agriculatural communi~ situated near the boundary of concentrated <br />urban development that has been designated as a rural center by <br />the Metropolitan Development Framework. The City Council has in <br />the development of its comprehensive sewer plan for the Ci~ of <br />Centerville defined a sewer service area consistent with metro- <br />politan framework guidelines. The City Council of the City of <br />Centerville finds to guide development to the urban service <br />areas as defined by comprehensive sewer plan and to prevent <br />undue pressure for urban services outside the defined service <br />area, that it shall be necessary to provide interim regulations <br />in the present zoning and land use ordinances. <br /> <br />SECTION 2. LEGISLATIVE INTENT <br /> <br />These regulations shall be necessary to protect the integrity <br />of the comprehensive sewer plan and shall be in force until such <br />time as the City shall be able to comply with provisions of the <br />Metropolitan Land Planning Act (MSA 473.175) by providing <br />necessary ordinances and regulations through proper procedure <br />as provided by Minnesota Statutes. <br /> <br />SECTION 1. AFFECTED AREAl Supercedes <br /> <br />This ordinance shall apply to and govern the entire area of the <br />City of Centerville during the period for which it is in effect. <br />This ordinance during its effective period shall replace and <br />supercede provisions in all other ordinances and regulations <br />applicable to the City of Centerville which are in conflict or <br />inconsistent with the provisions herein. All ordinances and <br />provisions therein which are not in conflict with the terms and <br />conditions of this ordinance shall continue in full force and effect. <br /> <br />SECTION 4. SCOPE OF CONTROL <br /> <br />Except as provided hereinafter in this ordinance during the <br />period of November I, 1977 to November I, 1978, neither the <br />Planning Commission of the City or the City Council shall grant <br />any preliminary or final approval to a subdivision plat, site <br />plan, rezoning, or other development map or application, unless <br />initiated by the Planning and Zoning Commission or the City <br />Council, or unless such subdivision plat, site plan, reznoning <br />has been filed with the Clerk's office prior to November I, 1977. <br /> <br />~ <br />
