<br />~ <br />( <br /> <br />ORDINANCE #28 <br />page two <br />SECTION V. GRANTING THE LICENSE <br /> <br />The City Council shall cause an investigation to be made of the <br />applicant. Opportunity shall be given to all persons to be heard <br />for or against the granting of the license. After the investigation <br />and the hearing, the City Council shall grant or refuse the appli- <br />cation at its discretion. Renewal of a license shall also be at <br />the discretion of the City Council. <br /> <br />SECTION VI. TERMS AND CONDITIONS <br /> <br />The terms and conditions for a Retail On-Sale Wine License issued <br />under this Ordinance shall be as follows. <br /> <br />A. The license shall be posted at all times in a conspicuous <br />place on the licensed premises. <br /> <br />B. Licenses shall not be transferable. The license shall only <br />be for the premises described in the application. <br /> <br />C. The licensed premises shall be open to inspection by any <br />police officer or other properly designated <br />officer or employee of the City at any time when it is open <br />to the public. <br /> <br />D. The licensee shall strictly observe all the laws relative to <br />the sale of wine set forth in Minnesota Statutes together with <br />all rules and regulations of the State Liquor Control Commissioner. <br /> <br />E. No Retail On-Sale Wine License shall be in effect until <br />approved by the State Liquor Control Commission. <br /> <br />F. Liability insurance in amounts described by the City Council <br />shall be required to be able to obtain approval for a Retail <br />On-Sale Wine License. <br /> <br />G. Any license issued under this Ordinance may be revoked by <br />the City Council for a violation of this Ordinance, a violation <br />of other City Ordinances, a violation of the laws of the State <br />of Minnesota or the United States. <br /> <br />H. The City Council reserves the right to suspend a license for <br />a period not to exceed ninety (90) days for cause. The City <br />Council would review all information and provide justification <br />for such a suspension. <br /> <br />SECTION VII. CLOSING HOURS <br /> <br />No sale of wine shall be made on any Sunday between the hours of <br />1:00 am and 12:00 noon and no sale shall be made between the hours <br />of 1.00 am and 8 :00 pm on any election day that is not solely a <br />municipal election. The foregoing closing hours may be further <br />restricted by City Council resolution from time to time. <br /> <br />~ <br />
