<br />~ 90.08 NUISANCES. <br /> <br />(A) Habitual barking. It shall be unlawful for any person to keep or harbor an animal which <br />habitually barks or cries. HABITUAL BARKING shall be defined as barking for repeated intervals of <br />at least five minutes with less than one minute of interruption. The barking must also be audible off of <br />the owner's or caretaker's premises. <br /> <br />(B) Chasing a/pedestrian/moving vehicles. It shall be unlawful for an owner to permit a dog or <br />other animal to chase vehicles or to molest or annoy any person while away from the property of its <br />owner. <br /> <br />(C) Damage to property. It shall be unlawful for any person's dog or other animal to damage any <br />lawn, garden or other property, whether or not the owner has knowledge of the damage. Any such <br />animal may be impounded as provided in this chapter, or a complaint may be issued by anyone <br />aggrieved by an animal under this chapter against the owner of the animal for prosecution under this <br />chapter. <br /> <br />(D) Cleaning up litterlfeces disposal. The owner of any animal shall be responsible for cleaning <br />up any feces of the animal and disposing of the feces in a sanitary manner as follows: <br /> <br />(1) During the period of November 1 through April 30, all feces material shall be removed <br />from the owner's premises and/or stored in a sanitary manner within seven days/one week; <br /> <br />(2) During the period of May 1 through October 31, all feces material shall be removed from <br />the owner's property and/or stored in a sanitary manner within 48 hours/two days; and <br /> <br />(3) Objectionable feces odor and/or flies detectable at the adjoining property line shall be <br />deemed a violation ofthis section. <br /> <br />(E) Device and container required. The owner of any animal shall not permit the animal to be on <br />public property or the property of another without having in the owner's immediate possession a device <br />for the immediate removal of feces material deposited by the animal, as well as a container for the <br />transport of the material to a proper disposal receptacle located on the property of the owner. <br />Immediate removal of feces is required in this instance. <br /> <br />(F) Exemptions. The provisions of this section shall not apply to any animal specifically trained <br />for and actually providing assistance to the physically challenged or other individuals with severe <br />disabilities who are unable to clean up after a companion dog; dogs when used in police activities by <br />the city; or tracking dogs when used by or with permission of the city. <br /> <br />(G) Written complaint. <br /> <br />(1) Any person aggrieved by an animal nuisance may make a written complaint to the Police <br />Department or other persons designated by the City Council, stating the acts complained of, the name <br />and address of the owner of the animal, and the name and address of the person making the complaint. <br /> <br />n1no <br />
