<br />(D) Handicapped and elderly persons. Any handicapped or elderly person who would have <br />difficulty using a group box location shall be exempt from this section upon notification of handicap or <br />physical condition to the City Hall. <br /> <br />(E) Removal of paper boxes from the right-ofway. As of 8-1-1990, all paper boxes not in group <br />locations will be removed from the city street right-of-way. <br /> <br />(F) Culs-de-sac. Group mailbox and paper box stands shall not be located in any cul-de-sac. Box <br />locations will be allowed on streets entering and leaving the cul-de-sac. <br /> <br />(G) New developments. Developer agreements shall provide for installation of mailboxes in new <br />developments. <br /> <br />(H) Maintenance. Maintenance of the mailboxes and platforms shall be the responsibility of the <br />residents served. <br />(Ord. 48, passed 5-24-1989) <br /> <br />~ 93.04 MAINTENANCE OF ADJOING RIGHT OF WAY. <br /> <br />(A) Duty of Property Owner to Cut Grass and Weeds and Maintain Trees and Shrubs. Every <br />owner of property abutting on any street shall cause the grass and weeds to be cut from the line of such <br />property nearest to such street to the center of such street. If the grass or weeds in such a place attain a <br />height in excess of eight (8) inches it shall be prima facie evidence of a failure to comply with this <br />Section. Every owner of property abutting on any street shall, subject to the provisions herein requiring <br />a permit therefore, trim, cut and otherwise maintain all trees and shrubs in a unhazardous and healthy <br />condition, from the line of such property nearest to such street to the center thereof. <br /> <br />(B) Failure of Owner. If the owner of the abutting property fails to maintain adjoining right of <br />way as required by this section, the city may secure compliance in the same manner as abatement of <br />nuisance violations and may order such work to be done under its direction and the cost thereof <br />assessed to the abutting property owner as any other special assessment. <br /> <br />(Adopted 10-11-2006) <br /> <br />USE OF RIGHTS-OF-WAY <br /> <br />~ 93.15 ELECTION TO MANAGE. <br /> <br />(A) To provide for the health, safety and welfare of its citizens, and to ensure the integrity of its <br />streets and the appropriate use of the rights-of-way, the city strives to keep its rights-of-way in a state <br />of good repair and free from unnecessary encumbrances. <br />
