<br />City of Centerville <br />July 23, 2003 <br />Council Meeting Minutes <br />evolved before the sod is installed to preclude future problems. Mr. Peterson indicated <br />that the City's field engineer has been there but as far as the City is concerned the City <br />has signed off on the final grading and it is the homeowners responsibility to make sure <br />the grade is correct when the home is purchased. He then said that they could check if <br />there are areas that do not appear to be draining properly but usually they just check <br />boulevards. <br /> <br />Council Member Capra indicated that Council had discussed the potential for a pre-sod <br />inspection. <br /> <br />Council Member Lee commented that this is not the only home that has an issue with this <br />and there are a lot of grading and drainage issues in the City but at some point the City is <br />no longer able to correct what the developer does. <br /> <br />Ms. Marilyn Newman of 7035 Dupre Road indicated that she moved in to her new home <br />in October of 2002 and is tired of driving through mud and having to clean her vehicle <br />and her garage. She then asked that Council be proactive rather than reactive on this <br />because she foresees drainage issues as her neighbor's home is higher than hers. She <br />further commented that the developer will not do anything unless the City tells them too <br />but the City says it is the responsibility of the developer and she wants to know how she <br />is supposed to solve these problems. Mr. Peterson indicated that the issue is between the <br />homeowner and the contractor as it is private property. <br /> <br />City Attorney Hoeft indicated that once the final grading plan is accepted then the City is <br />out of the grading issue. <br /> <br />Mr. Cliff Kath of 7001 Eagle Trail indicated that he has a drainage problem and some <br />people were out and walked it and said something needs to be done. He then said that <br />when he moved in there was a ditch there and Swift told him to put up a wall. He further <br />indicated that there is a manhole there and he has grading problems that he cannot get the <br />developer to resolve and this has been a two-year process. <br /> <br />Ms. Ann St. George of 1861 Pioneer Lane indicated that when the townhome next to <br />them was built she called the City because the foundation was higher than hers and the <br />City said it was fine three years ago. She then said that she does not feel that this should <br />be her financial responsibility to take the developer on in Court when the City approved <br />the foundation and now she has drainage issues. She further commented that she feels <br />the City has some responsibility to help them with the problem and she is feeling ignored. <br /> <br />Council Member Lee asked if it would be possible to do a procedural change and instead <br />of doing the final grade before the structure goes in have that be a preliminary grade <br />inspection and have the grade checked when the structure is built to solve drainage issues <br />for future developments. Mr. Peterson indicated that would require a full time person <br />there in a development of this size to verify that all houses that go up over a five to six <br />year period do not have the grade changed during construction. <br /> <br />Page 7 of24 <br />
