<br />City of Centerville <br />August 13, 2003 <br />Council Meeting Minutes <br /> <br />VI. PUBLIC HEARING(S) <br /> <br />1. Ordinance #49 - Noise <br /> <br />Council Member Capra indicated she contacted the U of M and obtained generalized <br />information on decibel levels. <br /> <br />City Attorney Hoeft indicated that in using this type of ordinance in another community, <br />they ran into concerns with regard to prosecution of the ordinance when it was <br />determined that the ambient noise level of the area exceeded the limits of the ordinance. <br />He then suggested that the City take readings in various parts of the City to determine <br />what the ambient noise level is. <br /> <br />Mr. Palzer indicated there have been noise complaints on air conditioners and pool <br />pumps. <br /> <br />Council Member Capra suggested taking readings at times and places of previous <br />complaints. <br /> <br />Council agreed to continue the public hearing and direct staff to purchase two decibel <br />meters and have stafftake readings and report to Council. <br /> <br />Motion was made bv Council Member Capra and seconded bv Council Member <br />Paar to continue the public heariDl!:. All in favor. Motion carried unanimouslv. <br /> <br />Council Member Capra indicated she has concerns with how the nuisance ordinance <br />relates to the noise ordinance. City Attorney Hoeft indicated that there is a condition in <br />the noise ordinance that indicates an officer can determine that a noise creates a nuisance. <br /> <br />Mayor Sweeney continued the public hearing to the next meeting. <br /> <br />2. Pheasant Marsh Phase III - MUSA/Comprehensive Plan Amendment & Final Plat <br /> <br />Mayor Sweeney opened the public hearing at 7:05 p.m. <br /> <br />Ms. Moore-Sykes indicated that the City has not yet received comments from the <br />Metropolitan Council on the MUSA advancement. She then recommended that any <br />approvals be contingent upon receiving approval from the Met Council. <br /> <br />Mr. Runkle indicated that he, his engineer and his attorney were present for the <br />discussion. He then said that, if it is determined that they are the cause of the water <br />issues, they will work diligently with the City to correct the problem. He further <br />commented that the drainage plan was prepared by the City's engineer and approved by <br />the City. <br /> <br />Page 4 of 13 <br />
