<br />Centerville City Council <br />Meeting Minutes <br />February 26,2003 <br /> <br />City Attorney Hoeft indicated the Chief had given the definition of potentially dangerous <br />dog and this dog meets one or two requirements, so there is no question that the <br />determination of Council will follow the recommendation of the Chief as well as state <br />statute. <br /> <br />Council Member Broussard Vickers indicated that the size of the dog does not matter. <br />She then commented that Ms. Wirth has several of the required items already and <br />declaring the dog potentially dangerous and requiring the fenced backyard, kennel, and <br />insurance, as well as, requiring that the dog be under the control of an adult when on <br />leash should not pose an undue hardship on Ms. Wirth. <br /> <br />Mayor Sweeney commented that running away from a dog or not stopping could provoke <br />the dog to attack and that may be why the people stopped when the dog approached them. <br /> <br />Motion bv Council Member Lee. seconded bv Council Member Broussard Vickers <br />to uphold the determination of the classification of potentiallv dan!!:erous do!!:. All in <br />favor. Motion carried unanimouslv. <br /> <br />Chief Heckman indicated that State Statute 347.515 requires a microchip be implanted <br />for identification. <br /> <br />Motion bv Council Member Broussard Vickers. seconded bv Council Member Paar <br />that the potentiallv dan!!:erous do!!: have a proper enclosure. the owner provide and <br />show proof annuallv of public liability insurance. when on leash be under the <br />control of someone 16 years of a!!:e or older. and that the owner provide proof of <br />microchip identification as provided bv state statute. All in favor. Motion carried <br />unanimouslv. <br /> <br />VI. PUBLIC HEARING(S) <br /> <br />None. <br /> <br />VII. BUSINESS <br /> <br />1. Resolution #03-011 - Wiseguy's Pizza and Pub Administrative Fine <br /> <br />Mayor Sweeney read a letter from the Police Department concerning the failed <br />compliance checks by Wiseguy's Pizza and Sager's Liquor. He then indicated that both <br />businesses would be fined $500. <br /> <br />Motion bv Council Member Capra. seconded bv Council Member Broussard <br />Vickers to approve Resolution #03-011.
